Definitions

In these Terms, unless otherwise defined, the following terms shall have the meanings ascribed to them below:-
"We" or "Our" or "Us" means comGateway (S) Pte Ltd and/or Gateway Express Inc.
"You" or "User" means any persons or entities accessing the Site and/or using the Services available under the Site.
"Site" means the website and the contents accessible at the URL link www.comGateway.com.
"Services" means all the services offered by us on the Site.
"Shipping to your U.S. Address" means the service described in Section 4 of these Terms.
"BuyForMe service" means the service described in Section 3 of these Terms.
"Product" or "Shipment" means the goods, merchandise, freight, parcels or goods purchased by User on the on‑line websites of merchants.
"Terms" means the terms of use set out herein.


Registration

  1. You must read, agree with and accept all of the Terms and the Privacy Policy, which include those terms of use expressly set out below and those incorporated by reference, before you may register to become a User.

  2. We strongly recommend that, as you read these Terms, you also access and read the information contained in the other pages and websites referred to herein, as they may contain further terms of use that apply to you as a User. Please note: underlined words and phrases are links to these pages and websites.

  3. Services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our Services are not available to children (persons under the age of 18). You may not use the Site and/or the Services if you do not meet these eligibility criteria.

  4. If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.

  5. Registering with HopShopGo is free. This U.S. address should only be used for receiving packages and not for any other purposes.


Use of Site

  1. You agree to comply with our security verification process.

  2. You may not transfer, sell or disclose your HopShopGo account or User ID to another party.

  3. You agree to comply at all times with these Terms and all applicable domestic and international laws, statutes, ordinances and regulations.

  4. You represent and warrant that all information provided to us will be accurate and complete.

  5. You acknowledge that you have been provided with the various usage plans detailing the service features, monthly subscription fee and all other fees applicable to the usage plan offered by us. You agree to pay all fees associated with the respective plan once you have chosen it. While we will use reasonable efforts to include accurate and up‑to‑date information on the Site, we make no warranties or representations as to the accuracy, timeliness or completeness of any information found on the Site.

  7. We do not warrant that this Site will always be accessible, uninterrupted, timely, error‑free or free from computer viruses or other invasive or damaging code, or that this website will not be affected by any inability to obtain or shortage of necessary materials, equipment facilities, power or telecommunications, lack of telecommunications equipment or facilities, or failure of information technology or telecommunications equipment or facilities.

  8. Without limiting other remedies, we may limit User's access to the Site, issue a warning, temporarily suspend, indefinitely suspend or terminate User's registration and refuse to provide the Services to User if: User breaches these Terms or the documents it incorporates by reference; we are unable to verify or authenticate any information User provides to us; or we believe that User's account may have been compromised. We reserve the right to terminate or suspend access to the Site at any time without assigning any reason. We shall not be liable to User or to any other party for any damages, losses, costs or expenses howsoever caused by or arising out of such termination or suspension.


BuyForMe Service

  1. We provide product‑ordering BuyForMe services to Users to assist them in purchasing merchandise from online merchants who may or may not otherwise accept their payments. We are not a retailer or reseller of the merchandise ordered.

  2. Only orders placed on the Site will be entertained and we do not accept any orders placed via telephone, e‑mail or the electronic chat service on the Site.

  3. We do not warrant that the items Users have ordered will be available for purchase and delivery. We will automatically cancel any item ordered if it is:

    • Out of stock;

    • Back‑ordered;

    • Available only at a higher price;

    • Ordered with ambiguous or insufficient information that is, in our sole opinion, necessary to place the order;

    • Items unsuitable to be transported by our freight agents; or

    • Items classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA, ICAO, any applicable government department or other relevant organization.

  4. If User has selected the option to process incomplete orders, we will, without notification, process the rest of the order. Otherwise, the entire order will be cancelled.

  5. While we will endeavor to execute orders promptly, User agrees that we will not be responsible for any delays. We reserve the right to reject any orders, at our discretion, at any time. We do not accept any requests to amend or cancel orders placed using the BuyForMe Service. All orders once placed are considered final.

  6. We will take all reasonable care to place User's orders correctly. Should there be any discrepancies, User must bring them to our attention within three (3) business days of us sending the merchant confirmation. After that, all errors are deemed accepted by User.

  7. Some merchants may insist that we do not forward their merchandise outside of the US. While we will try to maintain a list of such merchants on the Site, this list cannot be exhaustive, and we are not responsible for any change in any merchant's selling restrictions.

  8. Orders deemed unacceptable Shipments will be dealt with in accordance with Section 6.

  9. We do not process any rebates offered by the merchant in any form to Users. All product warranty issues must be taken up directly with the merchant.

  10. We reserve the right to reject any orders at our discretion at any time. All orders once placed are considered final.


Shipping to your U.S. Address

  1. Upon successful registration, User shall be allocated a U.S. delivery address which the User may then provide to online merchants as the delivery address ("U.S. Delivery Address") when purchasing Products. Such Products are to be subsequently delivered by us to the address designated by the User ("Shipment Address").

  2. You authorize us to accept delivery of Products at the U.S. Delivery Address on your behalf and appoint us as your freight agent to ship the Products to the Shipment Address in accordance with these Terms.

  3. We have the right to open and inspect a Shipment without prior notice to User.

  4. Notwithstanding any provision herein, we reserve the right at all times to decline or refuse to accept delivery of any purchase, Shipment, consolidation or return of any Products as we deem appropriate in our absolute discretion and without attributing any reason thereto.

  5. We may on User's behalf: complete any documents, amend product or service codes, pay any duties or taxes required under applicable laws and regulations, and/or act as User's freight agent for customs clearance and preparation of shipping documents. Item declaration amount will be based on the merchant invoice of the package.

  6. All Shipment Addresses once confirmed on the Site are final and may not be varied.

  7. User agrees to routing and diversion of the Shipment, including via intermediate stopping places, and to delivery by comGateway's assigned courier.

  8. User acknowledges and agrees that the services do not include customs or taxes (except where clearly stated) and that we are not a customs agent or broker. The user is solely responsible for any and all customs duties, tariffs, taxes or other charges relating to the Shipment.


Verification

  1. We may verify You and your credit cards used for payment on our Site at our discretion.

  2. We use various verification methods including but not limited to: requiring you to confirm a random code sent to your registered mobile phone; and/or requiring you to confirm a random code charged to your credit card.

  3. We reserve the right to refuse orders or withhold shipment for any transactions involving payments made with unverified credit cards.

  4. If orders paid with unverified cards are not verified within 35 days from placement, we will return the order to the merchant. Return charges, determined by the merchant, will be charged to your account.


Deliveries and Undeliverables

  1. Shipments will be delivered to the Shipment Address, but not necessarily to the named recipient personally. Shipments to addresses with a central receiving area will be delivered there.

  2. comGateway does not guarantee delivery of packages which do not comply with the import or export regulations of the destination country.

  3. If the recipient refuses delivery or the Shipment is deemed unacceptable, undervalued, unidentifiable, or if User/recipient does not respond to requests for payment of duties or charges, we will use reasonable efforts to return the Shipment to the merchant at User's cost. Failing which, the Shipment may be released, disposed of or sold by us without liability, with proceeds applied against service charges and related costs; any balance will be returned to User.

  4. We reserve the right to discard and/or dispose of Products delivered to the U.S. Delivery Address if we are unable to process delivery within ninety (90) days of their arrival, without liability to User.


Unacceptable Shipments

  1. User agrees that Products will be deemed unacceptable for Shipment if:

    • Classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA, ICAO or other relevant authorities;

    • No customs declaration is made when required;

    • We determine the item cannot be transported safely or legally (e.g. animals, currency, negotiable instruments, precious metals/stones, firearms/ammunition, human remains, pornography, illegal narcotics).

  2. Products deemed unacceptable will be returned to the merchant at User's cost and/or disposed of by us.


Claims and Insurance

  1. We provide Shipment insurance for loss or physical damage during transit up to the actual or declared cash value of US$5,000, whichever is lower.

  2. Insurance cost is calculated as a percentage of total shipment value, declared value of goods, domestic shipping charges (for BuyForMe items) and international shipping cost (excluding fuel surcharge and duties paid).

  3. Compensation includes declared value of goods, domestic shipping charges (for BuyForMe purchases) and international shipping costs (excluding fuel surcharge and duties paid).

  4. Shipping insurance is compulsory for all users.

  5. All claims for loss or damage must be made within fourteen (14) days from delivery date, in writing, with original consignment note, supporting documents and invoices/receipts.

  6. We reserve the right to inspect and/or collect goods claimed as damaged before settling claims. Compensation is paid only after verification.

  7. No third parties are entitled to benefit from claims for lost or damaged items.


Repack Service

  1. We offer a repack service for packages deemed suitable, with a repacking fee. Customers may choose this at checkout.

  2. User accepts that repacking may void the merchant's return policy or warranty.

  3. Repacking adds 1–4 business days to the delivery timing of the entire shipment.

  4. By accepting repack, you understand we may modify or discard items to reduce weight unless instructed otherwise:

    • External packaging

    • Shoe boxes

    • Gift boxes

    • Clothes hangers


Refund, Return and Exchange

  1. We are not responsible for merchant errors in order fulfillment. User must deal directly with merchants for returns, refunds or exchanges per merchant policies.

  2. We do not facilitate exchanges. We will handle return delivery of items from the U.S. Delivery Address. Return charges apply.

  3. Return charges will be deducted from any order cancellation refunds for BuyForMe orders.

  4. For direct merchant orders, User must pay return charges before we can return goods to the merchant.

  5. We will credit User with refunds only after receiving them from the merchant. We do not refund BuyForMe service fees.


Charges and Costs

  1. Service charges are shown under the respective usage plan and may change at our discretion. Fees are quoted in U.S. Dollars. Charges are calculated on the higher of actual or volumetric weight; consolidated shipment weight is the sum of each package’s chargeable weight.

  2. If payment is not received within the stipulated timeframe after goods arrive at the U.S. Delivery Address, a storage fee of US$1.00 per day applies. We store goods for a maximum of 90 days; thereafter, we may dispose of them without liability.

  3. User will compensate us for any penalties or fines incurred for prohibited, controlled, hazardous or illegal Shipments.

  4. For BuyForMe Service, item cost, merchant delivery charges and service fee (per usage plan) are charged to the User.


Indemnity and Limitation of Liability

  1. User agrees to indemnify and hold harmless the Interested Parties (comGateway (S) Pte Ltd, Gateway Express Inc. and BuyForMe payment company) from any claims, damages, expenses or losses arising from use of the Site or Services.

  2. In no event shall we be liable for any indirect, incidental, special, punitive, exemplary or consequential damages, or for lost profits or revenues, in connection with these Terms, Site access or Services.

  3. We do not warrant the quality of items purchased via the Site or the accuracy of manufacturer/distributor claims. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for purpose.


General

  1. We reserve the right to amend, vary, delete or add to these Terms at any time without notice; amended Terms apply immediately. Continued use of the Site or Services constitutes acceptance.

  2. Notices are given by email (effective 24 hours after sending) or by certified mail to our Singapore address (effective 3 days after mailing).

  3. These Terms are governed by the laws of the Republic of Singapore. Disputes are resolved by SIAC arbitration in Singapore with one arbitrator appointed by the SIAC Chairman.

  4. If any provision is invalid or unenforceable, it does not affect the remainder of these Terms.

  5. We are not liable for delays or losses caused by circumstances beyond our control, including acts of God, force majeure, riot, industrial action, or electrical/magnetic damage to data.


Should there be any discrepancy or inconsistency between the different language versions of these Terms and Conditions, the English version shall prevail.
